1. ABOUT US

Welcome to Paper Shores Design.

These Terms of Service explain the terms that apply when you visit our website, browse our products or place an order with us.

In these Terms, “Paper Shores Design”, “we”, “us” and “our” refer to Paper Shores Design. “You” and “your”refer to the person using our website or placing an order.

Our website is operated using Shopify, which provides the technology that allows us to operate our online store. However, when you purchase a product from Paper Shores Design, your contract of sale is with Paper Shores Design, not Shopify.

By using our website or placing an order, you agree to these Terms of Service together with our Privacy Policy and Refund & Returns Policy.

2. USING OUR WEBSITE

You may use our website for lawful purposes only.

You agree not to:

use our website for fraudulent or unlawful purposes;
attempt to gain unauthorised access to our website, systems or accounts;
interfere with the operation or security of our website;
knowingly introduce viruses, malicious code or other harmful material;
copy, reproduce or commercially exploit our website or its content without our permission; or
use our website in a way that could damage Paper Shores Design, our customers or our service providers.

We reserve the right to restrict access to our website where we reasonably believe that these Terms have been breached or where necessary to protect our website, business or customers.

3. OUR PRODUCTS

We take great care to ensure that our product descriptions, photographs and information are accurate.

However, colours shown on a computer, tablet or mobile device may vary slightly from the finished printed product depending on your screen, device settings and display.

We reserve the right to make minor changes to products where necessary, provided that the product continues to match its description and any agreed specifications.

If a product is personalised or customised, it will be produced using the information and instructions supplied by you.

Please check all names, dates, wording, spellings and other personalised information carefully before submitting your order.

We cannot be responsible for errors in personalised information that you have supplied incorrectly and which has been produced in accordance with that information.

This does not affect your statutory rights where a product is faulty, incorrectly produced or otherwise does not conform to the contract.

4. PERSONALISED AND MADE-TO-ORDER PRODUCTS

Some of our products are personalised, customised or made specifically to your requirements.

Because these products are created specifically for you, certain consumer cancellation rights may not apply where the law allows an exception for goods made to the customer's specifications or clearly personalised.

Our Refund & Returns Policy explains how cancellations, returns and refunds work for personalised and non-personalised products.

If you notice an error in your personalised order, please contact us as soon as possible.

Once personalised production has started, we may not be able to make changes or cancel the order where the law allows us to decline such a request.

Nothing in these Terms removes any statutory rights you have in relation to faulty, damaged, incorrectly produced or misdescribed goods.

5. PLACING AN ORDER

When you place an order through our website, you are making an offer to purchase the products in your order.

Your order will be accepted when we confirm acceptance of your order and/or begin processing it.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

a product is unavailable;
there has been an obvious pricing or product description error;
information supplied by you is incomplete or incorrect;
we reasonably suspect fraudulent activity; or
we are unable to fulfil the order for reasons outside our reasonable control.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled order.

Please check your order carefully before completing your purchase.

6. PERSONALISATION AND PROOFING

Where a product includes personalised wording, names, dates or other information, you are responsible for checking the information you provide before submitting your order.

Where we provide a proof for approval, you are responsible for checking the proof carefully before approving it.

Once a proof has been approved, production will proceed on the basis of that approval.

If we make an error that differs from the information you supplied or an approved proof, please contact us and we will work with you to resolve the issue in accordance with your statutory rights.

7. PRICES AND PAYMENT

All prices displayed on our website are in pounds sterling unless otherwise stated.

Delivery charges will be displayed separately where applicable.

We reserve the right to change prices at any time. However, changes will not affect orders that we have already accepted.

Promotional offers and discount codes may be subject to additional terms, including expiry dates, exclusions or minimum order values. These terms will be displayed with the relevant promotion.

Payment must be successfully received before an order can be processed.

8. SHIPPING AND DELIVERY

We aim to dispatch orders within the processing times shown on our website or communicated to you at the time of purchase.

Delivery times are estimates unless we have specifically agreed a guaranteed delivery date with you.

Once an order has been dispatched, delivery may be affected by circumstances outside our reasonable control, including postal delays, carrier disruption, customs processing and other unforeseen events.

If your order appears to be delayed or has not arrived within the expected timeframe, please contact us so that we can help.

Nothing in these Terms limits your statutory rights in relation to delivery, including where goods are lost, damaged or not delivered as required by law.

For international orders, customers are responsible for complying with any applicable local import requirements and, where applicable, paying customs duties, taxes or other charges imposed by the destination country.

9. CANCELLATIONS, RETURNS AND REFUNDS

Our Refund & Returns Policy explains our cancellation, return and refund procedures.

For eligible online purchases, consumers may have a legal right to cancel within the applicable cancellation period. Certain products, including goods that are made to the customer's specifications or clearly personalised, may be exempt from these cancellation rights where permitted by law.

Nothing in our Refund & Returns Policy or these Terms affects your statutory rights.

If a product is faulty, damaged, not as described or otherwise does not meet the requirements of consumer law, please contact us so that we can put the matter right.

10. PRODUCTS THAT ARE FAULTY OR INCORRECT

We want you to be delighted with your order.

If your product arrives damaged, is faulty, has been incorrectly personalised due to an error on our part, or is materially different from the product you ordered, please contact us as soon as reasonably possible.

Please provide photographs or other information where appropriate so that we can understand the problem and determine the best way to resolve it.

Depending on the circumstances and your legal rights, we may offer a replacement, repair, refund or other appropriate remedy.

Your statutory consumer rights are not affected by these Terms. Goods supplied to consumers must meet applicable legal standards, including being as described, of satisfactory quality and fit for purpose.

11. INTELLECTUAL PROPERTY

All content on our website, including but not limited to:

Paper Shores Design branding and logos;
artwork and illustrations;
product designs;
photographs;
graphics;
written content;
product descriptions; and
website design and layout

is owned by Paper Shores Design or our relevant licensors unless otherwise stated.

You may view and use our website for your personal, non-commercial use.

You must not copy, reproduce, modify, distribute, sell, commercially exploit or create derivative works from our designs, artwork, photographs, branding or other content without our prior written permission.

Purchasing a product from Paper Shores Design does not transfer ownership of the underlying artwork, design or intellectual property to you.

12. CUSTOMER-SUBMITTED CONTENT

If you provide photographs, artwork, wording or other content to us for the purpose of personalising or producing your order, you confirm that you have the necessary rights and permissions to allow us to use that content for the purpose of fulfilling your order.

You remain responsible for ensuring that any content you provide does not infringe another person's copyright, trademark, privacy or other rights.

We may refuse to reproduce content where we reasonably believe that doing so could breach the law or another person's rights.

13. REVIEWS AND FEEDBACK

We love hearing from our customers and welcome honest reviews and feedback.

By submitting a review, photograph or other feedback to us, you give Paper Shores Design permission to use that content for legitimate business purposes, including displaying it on our website, social media, marketing materials or other promotional channels.

We will not knowingly misrepresent a review or claim that a review was written by a customer if it was not.

We reserve the right to remove or decline to publish content that is unlawful, abusive, offensive, misleading, fraudulent or infringes another person's rights.

We will not be responsible for losses that are not reasonably foreseeable or which arise from circumstances outside our reasonable control, subject always to your statutory rights.

We will not be liable for business losses where you are purchasing as a consumer.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

We will not be responsible for failure or delay in performing our obligations where this is caused by circumstances outside our reasonable control.

If you are a consumer living in another part of the United Kingdom, you may also have the benefit of any mandatory consumer protections available to you under the laws applicable in your part of the UK.
